Terms of Service

Acceptance of terms

By creating a Nearish account, you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use the app.

These terms apply to all users of Nearish, including both partners in a synced Space.

The service

Nearish provides a private mobile application for long-distance couples and close friendships, including features such as daily prompts, memory timeline, date vault, shared calendar, vent room, shared notes, and status updates.

We reserve the right to modify, suspend, or discontinue any feature with reasonable notice. We will not substantially degrade the core service without providing at least 30 days' notice and a prorated refund for remaining subscription time.

Account eligibility

• You must be at least 18 years old to create an account.
• You must provide accurate information during account creation.
• You are responsible for keeping your account credentials secure.
• You may only maintain one account at a time.

Subscription and billing

Nearish is a premium-only app with the following terms:

• Free trial: 14 days of full access, no credit card required to start.
• Pricing: $50 USD per year, which covers both partners in a synced pair.
• Billing: Processed through Apple's App Store. Your subscription renews annually unless cancelled at least 24 hours before the renewal date.
• Refunds: Refund requests within 30 days of a charge are honoured at our discretion. Requests beyond 30 days are subject to Apple's standard refund policy.
• Price changes: We will provide at least 60 days' notice before any price increase. Existing subscribers will retain their current rate for their renewal period.

Your content

You own everything you create in Nearish — prompt answers, photos, voice notes, memories, letters, and notes. By using the service you grant Nearish a limited licence to store, sync, and display your content solely to provide the service to you and your partner. We do not use your content for any other purpose.

You are responsible for the content you create. Content that is illegal, harassing, or that violates any third party's rights is prohibited.

Acceptable use

You agree not to use Nearish to:

• Harass, threaten, or harm another person
• Share content that is illegal in your jurisdiction
• Attempt to access another user's account or data without authorisation
• Reverse engineer, scrape, or otherwise extract data from the service
• Use the service for any commercial purpose without our written consent
• Create accounts for minors

Violation of these terms may result in immediate account termination without refund.

The Vent Room

The Vent Room is designed as a safe, ephemeral space for honest emotional expression. Posts are automatically deleted after 24 hours and are not recoverable. You acknowledge that content posted in the Vent Room is visible to your synced partner and no one else. Do not use the Vent Room to make threats or to share content that constitutes harassment under applicable law.

Spaces and multi-person access

A Space is a private shared environment between two connected accounts. Each user can have up to 4 Spaces. Content within a Space is accessible to both connected accounts. When you disconnect from a Space, your partner retains their own copy of the content they created. Shared content handling upon disconnection is described in detail in our Privacy Policy.

Termination

You may delete your account at any time from the Profile tab in the app. All your data will be permanently deleted within 30 days. No partial refunds are provided for mid-period cancellations unless required by applicable law.

We may suspend or terminate your account if you violate these terms, with notice where reasonably practicable.

Limitation of liability

Nearish is provided "as is." To the fullest extent permitted by law, Nearish Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to loss of data or loss of relationship (genuinely not joking — please back up what matters to you).

Our total liability to you for any claim arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Governing law

These terms are governed by the laws of the State of Delaware, United States. Any disputes will be resolved through binding arbitration in accordance with the AAA Consumer Arbitration Rules, except where prohibited by local law.

Changes to these terms

We may update these terms. If the changes are material, we'll notify you by email and in-app notification at least 14 days before they take effect. Your continued use after that date constitutes acceptance.
